These terms and conditions govern the sale of paintings on the website www.arts.et.decouvertes.com.

1. Prices and Paintings

The prices appearing on this site are indicated in Euros, all fees included, excluding any contribution to the costs of making the items available (see delivery).
The works of art and antiques remain the sole property of the Arts et découvertes gallery until full payment of the indicated price.
VAT is not recoverable due to Article 293 B of the French General Tax Code.

2. Order and Transaction Confirmation

When you confirm your order, you declare that you have read and accepted these general terms and conditions of sale in their entirety.
As soon as your order is registered, an acknowledgment of receipt will be sent to you by email after payment validation.
We reserve the right, however, to cancel any order from a customer with whom we have a payment dispute regarding a previous order.

3. Payment

Payment for your purchases is made in euros only.

By credit card:
Payment is made online when placing your order. Secure payment is possible using the PayPlug or Prestashop Checkout payment module.

By check:
Payable to SASU Felix Denariaz, in euros only. The check must be issued by a bank domiciled in France.
Send to SASU Felix Denariaz, 9 impasse de l’ancienne Mairie, 84240 Ansouis.
Delivery will be made upon receipt of the check.

4. Delivery

Shipping costs vary depending on the artwork and the destination; you will be notified of these costs when you place your order, upon separate order, directly with the gallery.
Transportation times may vary depending on the volume, weight, region, and destination country. Delivery will be made to the address you indicate on the order form.
Depending on the country of delivery, you may be required to pay customs taxes and other fees applicable in your country upon receipt of your artwork. We do not know the amount of these taxes and are unable to provide you with reliable information. We therefore invite you to contact the relevant authorities in your country, who will be able to provide you with information on this matter.
For deliveries to France and European Union countries, there are no customs fees to pay.

Reservations upon receipt of the works:
In the event of a defect or damage, it is your responsibility to express specific and detailed reservations to the carrier, indicating “subject to reservation” on the delivery slip, in order to benefit from the insurance purchased.
The list of damages must be emailed to the Arts et découvertes gallery no later than 24 hours after delivery.

5. Liability

The Arts et découvertes gallery shall not be liable for non-performance of the contract due to reasons beyond its control, particularly in the event of force majeure, disruptions, or strikes in postal services, transportation, and/or communications.

6. Rights to the Work and Intellectual Property

The artist retains the copyright. The rights to represent and reproduce the works displayed on the website www.artsetdecouvertes.com belong to their authors. Their authorization is required for any use of these rights.
All elements appearing on the website are protected by copyright, trademark law, and all other intellectual property rights. No reproduction and/or adaptation may be made without their authorization.

7. Privacy Policy

To place an order, you will be required to provide us with certain information that will be subject to computer processing. By confirming your order, you authorize us to process your file. This information may be shared with organizations. By confirming your order, you authorize us to distribute it under these conditions. In accordance with the law of January 6, 1978, you can access this information, request its modification or rectification or request to no longer appear in our database by sending us an email to: arts.et.découvertes.provence@gmail.com

8. Applicable Laws – Jurisdiction

This contract is subject to French law. In the event of a dispute, the Avignon court has exclusive jurisdiction, and you acknowledge your acceptance of its exclusive jurisdiction.
Ordered works are invoiced at the price in effect at the time the order is placed.
For orders outside mainland France: you are the importer of the work in question. For works shipped outside Europe, taxes may be applicable. These duties and amounts are not the responsibility of the Arts et Découvertes gallery. They will be your responsibility and are your sole responsibility, both in terms of declarations and payments to the competent authorities and organizations in your country.
